Citizens can sound off on short-term rentals at special hearing today

Citizen concerns about reportedly disturbing activities at “short-term rentals” prompted the Middlesex County Board of Supervisors to review related county ordinances.

A public hearing by the Middlesex Planning Commission on proposed zoning ordinance amendments for short-term rentals is set for 7 p.m. today, Thursday, Feb. 9, at the Middlesex County Historic Courthouse in Saluda.

“Citizen concerns include, but were not limited to, noise and misbehavior, parking, possible trespass, over exceedance of occupancy, resulting in sewage disposal failure, lack of adjoining property owner input regarding the use, general safety and possible impacts on property values,” states the staff report of Middlesex Zoning Administrator David Kretz.
The current “tourist home” section of the ordinance, which regulates short-term rental of residential homes, has been in force since July 2018.

Just how much authority a locality will have over short-term rentals is unclear due to bills pending in the General Assembly. If enacted, SB 1391 and HB 2271 would restrict a locality’s ability to restrict property if it is managed by a Virginia Realtor. Staff has reviewed the proposed legislation against the draft amended short-term rental ordinance provisions and has found no apparent conflicts
