While upgrading electrical service to the Northern Neck, in May through August 2020, Dominion Energy (DE) used an easement located on Route 3 across from the entrance to Grey’s Point Campground owned by Toney to store pallets and equipment.
According to Toney, whose family has owned the land since 1946, there had never been any flooding or ponding on the site until after DE finished work and left.
Kenyear also said on Friday he has lived in his home next to the easement in the Beverley subdivision for 20 years and there has never been any “ponding” until after DE finished using the easement for storage of pallets.
Since December 2020, Toney and Kenyear have been in communication with DE officials concerning the matter and they continued to report DE “does not feel it has any liability in the matter.” However, a repair bid was submitted by a local contractor to DE to fix the problem for $1,920 and DE officials agreed to provide the funds.
Toney mailed bids to DE officials on March 22 and received a letter from a company representative stating DE does not feel liable for the damage…
